Since
1998, customers from many nations and various walk of life, most of them without
previous import experience, used our
services to purchase vehicles, directly from Japan. Importing
cars for personal use or for resale, is usually easier than it
seems. For peace of mind, read the guidelines below.
We are looking forward doing good business with

1) Stock list,
vehicle & price
|
|
We purchase our
cars from reliable sources (preferably from Japan dealer trade auctions, where vehicle
background, history & status is thoroughly investigated). Overall
condition, engine, transmission and electrical system are verified, as well as functionality
of all features and interior condition (for unusual wear & tear,
discoloration or smell). After being washed, documented and photographed,
vehicles are stored within dry, clean & safe premises, until sale &
shipment.
All vehicles are legal property of Best Japan
Co., Ltd., including brand new cars or auction requests purchased at customer
request. Vehicles must be our legal property, in order for export
procedures and shipment to be allowed. We never advertise nor sell, third
party vehicles.

NOTE:
Customers are welcome to suggest reasonable price offers
for vehicles they wish to purchase. When an offer is
accepted, customer is expected to commit immediately. When more than one party
want the same car,
it is sold to the first one to commit financially

2) Purchase
& Agreement
To initiate purchase, customer writes to specify vehicle, intended port
of destination and purchaser's details (name, address & contact number).
In return, we forward
(email attachment) a Sales Agreement
confirming vehicle details, CIF price, shipping schedule and payment
instructions. Feel free to ask for any
relevant information, preferably before initiating purchase. Acceptance of
our Sales Agreement implies terms of trade hereafter, were understood &
accepted.
NOTE:
Most countries allow car imports by private
users. Some countries however, enforce restrictions based on vehicle model,
type or age.
It is always customer's
responsibility, not ours, to verify the feasibility of his project, before committing
to a purchase

3)
Payment, modes & method
FULL payment is required before we apply for an Export Certificate and initiate shipping procedures. We
might accept fractionated payment, as long as customer
understands shipping will be delayed until vehicle is totally paid.
DEPOSIT payment is
required to HOLD a vehicle on customer's behalf or to initiate an auction
purchase request. When outstanding balance payment is confirmed, the vehicle is removed from
web advertising (or from auction house yard), and shipping is initiated.
METHOD of payment is exclusively via international fund wire, from bank to bank (TT),
with the sole exception of visiting customers and residents of Japan, where cash payment is acceptable.
NOTE:
In respect with privacy, customer personal, prices & transaction
details are never shared with anyone, for any reason. To protect against
money launderers, scams & frauds, use of
credit cards, checks, Paypal or Western Union, is not accepted.

4) Refund
policy
Best Japan Co. Ltd, guarantees that the
vehicle shipped to customer is the vehicle actually purchased, as clearly
identified by its original Export Certificate. No claim,
financial compensation or refund request, can be taken
into consideration, for any reason other than for cause of no shipment, lost shipment
or as stated below:
A- Cancellation of an AUCTION REQUEST PURCHASE
1) Best Japan Co.,
Ltd. is responsible for cancellation of an AUCTION REQUEST. We failed to
finalize successfully a purchase request
for reasons clearly imputable to our negligence or incompetence. Customer
is entitled to refund of
deposit (minus expenses incurred, if any).
2) Customer is responsible for cancellation of an AUCTION REQUEST. A customer decides to cancel a purchase
request prematurely, for any
reason not resulting from our
negligence or incompetence. We refund
the deposit, deducted by a 50% cancellation fee.
B- Cancellation of a STOCK LIST VEHICLE
PURCHASE
1) Best Japan Co., Ltd. is responsible for cancellation of a STOCK PURCHASE.
For some reason, a vehicle becomes unavailable and cannot be shipped. We return funds
received, or provide another
unit, at customer's preference.
2) Customer
is responsible for cancellation of a STOCK PURCHASE, after it is paid for
and before it is shipped. We will refund payment, deducted by a 50% of CIF price cancellation fee,
only if the cancellation order is received before we obtain an EXPORT CERTIFICATE.
About EXPORT
CERTIFICATE:
Issuing of an Export Certificate, not only
implies a vehicle CAN be exported, but also that it is no longer technically
valid for use within Japan, and MUST be exported (or
destroyed at shipper's expense). A refund is impossible after an Export Certificate is issued.

5) Domestic
transfers & International Shipping
Vehicle price listed in the stock list, always includes the price of the
vehicle and the following:

Road
& ferry transfers from premises/auction house, to international
departure area

Cancellation
of registration, Export Certificate, Customs clearance & inspection
fee

Bonded
area storage until shipping, forwarding documentation via courier
services
Occasionally, such
as at times of FREE SHIPPING offers, listed vehicle price may also include
international freight & insurance charges.
Vehicles are
transported by professional carriers, from storage premises (or
auction yard), to shipper's facilities.
We usually favor dedicated carriers "roll-on & roll-of" services
for international delivery, but container shipping services can also be arranged. Marine insurance is included in
freight charges. Basic coverage is for damage & total loss, clearly
imputable to negligence of the carrier, disasters & acts of God
NOTE:
Best Japan Co., Ltd. can bear no responsibility for
inconvenience, loss or
damage caused by shipping delays (adverse weather,
overbooking, acts of war & terror, etc). Our service ends when a vehicle is shipped and documentation is forwarded
About BILL OF LADING:
When a vehicle exported via our services, is loaded onboard a marine vessel, the vehicle purchaser/owner
automatically enters an agreement with the carrier company issuing the
Bill of Lading. The vehicle purchaser, owner of shipment, or shipment consignee (not Best
Japan Co., Ltd.) agrees to be bound
by all terms & conditions written, typed, stamped
and printed on the face and back of original Bill of Lading, issued by carrier.

6)
Vehicle & Shipping Documents
The shipper agent, supervises custom clearance, booking & reservation of vessel
space and safe
keeping until boarding. Export Certificates and Bill of Lading, usually
return to us within 7 to10 days from
vessel departure. Documents are then forwarded to customer or to his designated agent, via EMS/UPS
courier services. In most cases, documents reach destination, within 2
weeks from actual sailing date.
Type of documents/items provided:
1) CIF receipt of sale (commercial
invoice describing unit & price) for purchaser record & tax/duty calculation
purposes
2) Bilingual Export
Certificate, individually delivered by Ministry of Transport, upon request from an
authorized exporter
3) Original copy of Bill of
Lading (usually 2 first original copies out of a total of 3), required to collect vehicle at destination
4) Owner manuals, maintenance notes,
loose/small items when available, are
either hidden in cars or forwarded separately
NOTE:
Since July 2005,
Japanese exporters must be authorized shippers and obtain an EXPORT
CERTIFICATE for all vehicles sold & shipped out of Japan. Japan Port Customs Authorities will not clear cars without
an Export Certificate.

7) Quality Standards
Japanese market used vehicle condition, is usually above reasonable expectations, in
comparison to the rest of the world. Because however, we trade used motor vehicles, some of them quite old, we cannot
issue a warranty with purchases. Vehicles are reasonably cleaned (body & cabin) prior to
shipping. Do
not hesitate to ask when refrigerant gas must be removed or when vehicle
should be steam cleaned. We will comply
to the best of our ability.
Quality evaluation of auction vehicles is typically done in
three steps:
1) Selling party provides a
vehicle status report which must be true (or face sanctions from auction
association)
2) Auction staff thoroughly check
vehicles and provide a detailed condition report, from which auction members
make purchase decisions
3) In the case of live auction, we will
physically verify the auction report information to the best of our
ability, usually the day before the sale
NOTE:
Our cars are legal in Japan
and exported as
is. Consumable such as tires, filters, belts, gaskets, light bulbs, brake
pads & discs, clutch, wipers, glass, batteries, etc., variable such as fluid
levels, fuel consumption, emissions & noise levels, instruments or odometer
precision & readings, hidden corrosion, etc., are not tested nor verified, therefore
not guaranteed to meet expectations or requirements at destination.
Reminder: It is always customer's responsibility (not
ours) to keep updated and avoid breaking destination country rules, either willingly or by ignorance, as we will bear no responsibility with
any consequence. No
claim can be taken
into consideration, other than stated in "Refund policy"
item above.

Auction purchase request
We constantly monitor & research a nationwide dealer
auction network internet portal, with 59 auction
halls (about 500,000 vehicles monthly). Registration and payment of a refundable
deposit allows customer to gain access to
confidential auction data. The fixed fee deposit, actually securing
handling fee & shipping costs at completion of purchase, is required initially.

Final payment of a successful
auction purchase invoice

When a winning bid is confirmed,
we immediately provide proof of purchase and request payment of items
below. Payment of successful
auction purchase invoice should be finalized (i.e. available in Japan, to our bank account), within 5
calendar days, from submission of invoice. Delays in payment or
insufficient payment must be avoided as it automatically result in penalties.

Penalties for default, delayed

Since a member sends bidding instructions,
only hours before actual
auction start, it should be safe to assume funds are unconditionally available, ready to be wired immediately upon notification of
a successful purchase. In case of a customer late purchase payment, we must pay the bill using our own funds
or face expulsion from auction membership

Unless
payment is available
(into our Japan account & usable), within 5
calendar days from auction invoice submission, late penalty fee automatically
apply at yen 10,000 per day, starting from day
6 after invoice submission and for a maximum of 10 days. When late payment
penalties reach yen 100,000 initial deposit is
lost and car is sold back at auction to try recover our losses

5)
Cancellation of successful
auction purchase
-
Auto auctions serve the needs
of professionals, who are expected to take responsibility for
their actions. Unless the
fault lies with auction house negligence (i.e. incomplete documentation), cancellation of a successful
auction purchase is impossible.

To minimize such risk, before entering a member's
bid, we insure the bidding
instructions received are genuine and truly understood. Clerical
or typing mistakes cannot happen as members are not
allowed to enter auction bids without our supervision

Miscellaneous
1. Choice of Law and
Venue. The laws of the Prefecture of Hokkaido, in Japan, without giving effect to its choice of law principles shall govern the applicability, interpretation and validity of these
Trade Terms. You hereby agree that the Courts located in Sapporo, Japan shall be the exclusive venue for any dispute, action, claim or contest arising out of or related in any manner to the
Trade Terms.
2. Construction. The Parties acknowledge that each Party has reviewed
these Trade Terms and has had the opportunity to have it reviewed by legal counsel. If any words or phrases
are stricken or otherwise eliminated, whether or not other words or phrases have been added, these
Trade Terms shall be construed as if the words or phrases stricken or otherwise eliminated were never included in these
Trade Terms, and no implication or inference will be drawn from the fact that the words or phrases were stricken or otherwise eliminated.
3. Entire Agreement. These Trade Terms are the entire agreement between You and Best Japan Co., Ltd. pertaining to
Your access and use for any purpose whatsoever of the Website and the Services
offered. There are no oral promises, understandings, interpretations or
terms of any kind as conditions to the acceptance by You of the Trade
Terms. Best Japan Co., Ltd. may amend, modify, change, revise or alter in any manner Best Japan Co., Ltd. deems necessary and its absolute and sole discretion the
Trade Terms of the Website without notice to You and without Your consent.
